4. How we disclose your information
We do not sell your personal information for money, and we never have. We disclose personal information only as described below.
4.1 Service providers. We disclose personal information to service providers that perform functions on our behalf, including our e-commerce platform, payment processors, shipping and fulfillment partners, email and SMS marketing platforms, analytics providers, customer support tools, and fraud prevention services. These providers may access personal information only as necessary to perform their functions and are contractually prohibited from using it for any other purpose.
4.2 Advertising partners. Like most online retailers, we use pixels and similar technologies from advertising platforms to measure campaign performance and deliver interest-based advertising. These partners may receive identifiers (such as hashed email addresses), device information, and information about your activity on our Site. Under certain state privacy laws, this may be considered "sharing" or "targeted advertising," and you have the right to opt out; see Section 6.
4.3 Corporate transactions. If we are involved in a merger, acquisition, financing, reorganization, or sale of some or all of our assets, personal information may be transferred as part of that transaction, subject to standard confidentiality protections. We will notify you of any transaction that results in your information becoming subject to a materially different privacy policy.
4.4 Legal and safety. We may disclose personal information where required by law, regulation, subpoena, or court order; to cooperate with law enforcement or regulatory authorities; or where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Apér Labs, our customers, or the public.
5. Cookies and tracking technologies
We and our partners use cookies, pixels, web beacons, and similar technologies to operate the Site, understand how it is used, and support our marketing. They fall into four categories:
- Strictly necessary: shopping cart, secure checkout, account login, fraud prevention. The Site cannot function without these, and they cannot be disabled.
- Performance and analytics: understanding Site traffic, page performance, and how visitors navigate the Site. You can opt out through your browser settings.
- Functional: remembering preferences such as items viewed, region, and saved cart contents. You can opt out through your browser settings.
- Advertising: measuring ad campaigns and delivering interest-based ads on third-party platforms. You can opt out using the methods below.
Your tracking choices
- Your Privacy Choices: use the "Your Privacy Choices" link in our footer to opt out of the sale or sharing of your personal information and of targeted advertising
- Consent banner: where your region requires one, a cookie consent banner appears on your first visit and lets you manage your preferences
- Browser controls: most browsers let you block or delete cookies through settings
- Global Privacy Control (GPC): we honor the GPC browser signal as a valid opt-out of sale or sharing where required by law
- Industry opt-outs: visit optout.aboutads.info (Digital Advertising Alliance) or optout.networkadvertising.org (Network Advertising Initiative) to opt out of interest-based advertising from participating companies
Please note that opting out of advertising cookies does not mean you will stop seeing ads, only that the ads you see may be less relevant to you.
6. Your privacy rights and choices
6.1 Rights available to everyone
- Marketing opt-out: unsubscribe from emails via the link in any message; reply STOP to opt out of SMS
- Access: request a copy of the personal information we hold about you
- Correction: ask us to fix inaccurate information
- Deletion: ask us to delete your account and personal information
Submit any request to privacy@aperlabs.com. We may need to verify your identity before fulfilling certain requests.
6.2 U.S. state privacy rights
If you reside in California, Florida, Colorado, Connecticut, Virginia, Texas, Oregon, Montana, or another state with a comprehensive privacy law, you may have some or all of the following rights, depending on your state:
- Right to know / access: the categories and specific pieces of personal information we have collected, the purposes, and the categories of third parties to whom it was disclosed
- Right to delete: subject to legal exceptions (e.g., completing transactions, fraud prevention, legal compliance)
- Right to correct inaccurate personal information
- Right to data portability: receive your information in a usable format
- Right to opt out of "sale," "sharing," targeted advertising, and certain profiling
- Right to limit use of sensitive personal information (we collect none beyond what is necessary to fulfill orders)
- Right to non-discrimination for exercising your privacy rights
To exercise these rights, email privacy@aperlabs.com with the subject line "Privacy Request," or use the "Your Privacy Choices" link in our Site footer. We respond to verifiable requests within the timeframe required by your state (generally 45 days). You may authorize an agent to act on your behalf; we will require proof of authorization and may still need to verify your identity directly. If we decline a request, you may appeal by replying to our decision, and we will respond to your appeal as required by applicable law.
6.3 International visitors
Our Services are operated from the United States and intended for U.S. customers. We ship within the United States only. If you access the Site from outside the U.S., you understand that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your jurisdiction.
7. Email and SMS communications
When you subscribe to our list, create an account, or make a purchase, you may receive marketing emails featuring new products, offers, and skincare education. Every marketing email we send includes a one-click unsubscribe link, identifies Apér Labs as the sender, and includes our physical mailing address, consistent with the CAN-SPAM Act. Opt-out requests are honored promptly and in all cases within 10 business days.
SMS messages are sent only to customers who expressly opt in. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. Your phone number is never shared with third parties for their own marketing.
Transactional messages, such as order confirmations, shipping updates, and account notices, are sent as part of providing the Services and are not affected by marketing opt-outs.
8. Data retention and security
We retain personal information only as long as reasonably necessary for the purposes described in this policy. As a general matter: order and transaction records are retained for up to seven years to satisfy tax, accounting, and legal requirements; marketing data is retained until you unsubscribe or request deletion; and account data is retained until you ask us to close your account. When information is no longer needed, we delete or de-identify it.
We protect personal information using administrative, technical, and physical safeguards appropriate to the nature of the data, including TLS/SSL encryption in transit, PCI DSS-compliant payment processing through our e-commerce platform, access controls, and data minimization. No system is impenetrable, and we cannot guarantee absolute security, but if a breach affecting your personal information occurs, we will notify you as required by applicable law.
Keep your account password confidential, and contact us immediately at privacy@aperlabs.com if you suspect unauthorized activity on your account.
9. Third-party websites
The Site may link to third-party websites and social media platforms. We do not control those sites and are not responsible for their privacy practices. This Privacy Policy applies only to information collected by Apér Labs. We encourage you to read the privacy policy of every website you visit.
10. Children's privacy
The Site is intended for general audiences and is not directed to children. We do not knowingly collect personal information from anyone under the age of 16. If you are under 16, please do not use the Site, make a purchase, or provide any information about yourself. If we learn we have collected personal information from a child under 16, we will delete it promptly. If you believe a child under 16 may have provided us personal information, contact us at privacy@aperlabs.com.
11. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we do, we will revise the "Last updated" date at the top of this page, and for material changes we will provide additional notice, such as an email or a prominent notice on the Site. We encourage you to review this page periodically.
