Terms of service
These terms govern every order placed at aperlabs.com and every use of the site. Apér Labs is operated by TV SKIN LLC, a Florida limited liability company.
These terms
Placing an order or using aperlabs.com means you accept these terms. If you do not accept them, do not use the site.
"We", "us" and "Apér Labs" mean TV SKIN LLC. "You" means the person using the site or placing the order.
Our Refund Policy, Privacy Policy and Shipping Policy are part of these terms. Where a specific policy conflicts with this document, the specific policy governs that subject.
We may change these terms. The version posted when you place an order is the version that applies to that order. Continued use of the site after a change means you accept the updated terms.
Eligibility and accounts
You must be at least 18 and able to enter a binding contract. We sell to customers in the United States only.
If you create an account, keep your login details secure and tell us promptly if you believe someone else is using them. You are responsible for activity under your account. We may suspend or close an account that is used in breach of these terms.
Orders, pricing and payment
Your order is an offer to buy. The contract forms when we send a shipping confirmation, not when you submit the order or receive an order confirmation email.
We may decline or cancel any order, including after confirmation, and will refund you in full if we do. Reasons include stock running out, a pricing or description error, suspected fraud or reseller activity, and quantity limits we apply to keep stock available.
Prices are in US dollars and exclude sales tax and shipping, which are shown at checkout. Prices can change without notice, but a change never affects an order already placed. If a product is listed at an obviously incorrect price, we may cancel the order rather than honor it.
Payment is taken at checkout through our payment processor. We do not store your full card details.
Shipping, delivery and returns
Delivery estimates are estimates, not guarantees. We are not liable for carrier delays once a parcel has left us.
Title and risk of loss pass to you when the carrier delivers to the address you gave us. If a parcel arrives damaged, tell us within 14 days and we will make it right under the Refund Policy.
You are responsible for the accuracy of your shipping address. Orders returned to us as undeliverable because of an incorrect address can be reshipped at your cost or refunded less shipping.
Returns and refunds are governed by our Refund Policy, which includes a 30-day guarantee covering opened product.
About our products
Our products are cosmetics, not drugs. They are intended to improve the appearance of skin. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and these statements have not been evaluated by the Food and Drug Administration.
Nothing on this site is medical advice. If you have a skin condition, are pregnant or nursing, or are using prescription topicals, speak to a physician or dermatologist before use.
Patch test before first use: apply a small amount to the inner forearm and wait 24 hours. Stop using the product if irritation, rash or discomfort develops, and contact us at info@aperlabs.com. Seek medical attention if a reaction is severe.
Ingredient lists are published on each product page and printed on the carton. Check them against any known sensitivities before you order. Results vary between people, and we do not promise a particular outcome.
Store as directed on the carton and use within the period indicated after opening.
Your content and ours
If you post a review, photo, video or comment to our site, or tag us publicly on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in our marketing, on our site and on our own channels, with attribution to your handle where practical. You can ask us to stop using it at any time by emailing info@aperlabs.com, and we will remove it going forward.
You confirm that content you post is yours to share, that any identifiable person in it has agreed, and that it is honest about your own experience.
We may remove any content from our site for any reason.
Everything else on aperlabs.com (the name Apér Labs, our logo, product names, photography, text, and the design of the site) belongs to us or our licensors. You may not copy, reproduce or use it commercially without our written permission.
Acceptable use
Do not use this site to break the law, infringe anyone's rights, or interfere with how it runs. In particular, do not:
- Buy for resale without our written agreement
- Scrape, crawl or harvest data from the site
- Attempt to gain unauthorised access to any part of it
- Upload malicious code, or anything defamatory, obscene or harassing
- Misrepresent your identity or affiliation with us
Disclaimers and limitation of liability
The site and its content are provided as is. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free.
To the fullest extent the law allows, our total liability to you for any claim arising out of your purchase or use of the site is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for lost profits.
Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud, for death or personal injury caused by negligence, or under any non-waivable consumer protection statute. Some states do not allow certain exclusions, so parts of this section may not apply to you.
Disputes and governing law
Tell us first. Email info@aperlabs.com and give us 30 days to resolve the problem before starting any formal proceeding. Most things are settled this way.
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules.
Arbitration and class action waiver. Any dispute that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Miami-Dade County, Florida. You and we each waive the right to a jury trial and to participate in a class, collective or representative action. The arbitrator may not consolidate claims or preside over any form of class proceeding.
You can opt out. Email info@aperlabs.com within 30 days of your first order with the subject line "Arbitration Opt-Out" and your order number. Opting out costs you nothing and does not affect the rest of these terms.
Either party may bring an individual claim in small claims court instead of arbitration. Claims must be brought within one year of the event giving rise to them, to the extent the law allows.
General
If any provision of these terms is held unenforceable, the rest stay in force. Our failure to enforce a provision is not a waiver of it.
You may not assign these terms. We may assign them in connection with a merger, acquisition or sale of assets.
These terms, together with the Refund Policy, Privacy Policy and Shipping Policy, are the entire agreement between us about your use of the site, and replace anything said or written before.
We are not liable for failure to perform caused by events outside our reasonable control, including carrier failures, supply interruptions and natural events.
